JUDGMENT / ORDER

The main grievance of the writ petitioner is that even though he made a representation dated 24.06.1999 to the 1st respondent – Municipal Commissioner, Anakapalli seeking to regularise 480 square feet of his land, which is equivalent to 93 square yards, in T.S.No. 140 in Block No.2, Anakapalli wherein he constructed building, in terms of the Orders issued by the Government in G.O.M.s.No.361, dated 15.04.1989, the 1st respondent has neither considered his representation nor regularized the land in question so far. Hence, the present writ petition is filed seeking appropriate directions.
This Court, by order date 26.04.2004, while admitting the writ petition directed the parties to maintain status quo with regard to possession of the land.
In the absence of counter affidavit filed by the respondents denying the pleadings, and on prima facie consideration of the averments made in the writ affidavit and on a perusal of the G.O.Ms.No. 361, dated 15.04.1989, this Court deems it appropriate to dispose of the writ petition with the following directions:
“The respondents are directed to consider the representation dated 24.06.1999 said to have been made by the petitioner and pass appropriate orders thereon in accordance with law by taking into account the eligibility or otherwise of the petitioner in terms of G.O.Ms.No.361, dated 15.04.1989 or any other Government Order that may relevant, within a period of twelve weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of.
No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
