The present bail application has been filed by the applicant in S.T. No. 73 of 2017 in Case Crime No. 1130 of 2016, u/s 498A, 304B IPC and 3/4 D.P. Act, P.S. Katghar, District Moradabad with the prayer for enlarging him on bail.
Having heard Sri Shahabuddin learned counsel for the applicant, learned AGA for the State and perused the post mortem report.
I may record that the deceased died on account of consumption of poison and in the viscera report aluminium phosphide insecticide was detected. It has been argued that the deceased committed suicide by consuming poison, however, I find that there are several ante mortem injuries on the various parts of the body of the deceased, has been noted which prima facie shows that infact she was administered poison after using force. At this stage I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, it has been stated by the counsel for the applicant that the applicant is in jail since 8.10.2016. The trial court is directed to expedite the trial and conclude the same preferably within the period of six months from the date of production of the certified copy of this order before the trial court.
