Heard Anil Kumar Dubey, learned counsel for the applicant and Sri Kapil Dev Singh Rathor, learned counsel for the electricity departyment.
The present 482 Cr.P.C. application has been filed to quash the entire proceedings in Crl. Case No. 289 of 2017 arising out of Case Crime No. 289 of 2017 (State Vs. Sarfaraj Noor) pending in the Court of Special Judge E.C. Act, Pilibhit, Police Station- Kotwali, District- Pilibhit, pending in the court of Special Judge E.C. Act, Pilibhit.
Learned counsel for the applicants submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within three weeks from today and the trial court shall decide the same within a period of one month from the date of filing of application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid observations, this application is disposed of.
