Heard the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondents.
This writ petition is filed, seeking to issue a writ of mandamus, declaring the action of the respondents in not releasing the pensionary and other retirement benefits to the petitioner as illegal, discriminatory and violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to pay the pensionary and other retirement benefits to the petitioner forthwith with interest.
It is submitted by the petitioner that he was appointed as driver in respondent-corporation in the year 1974 and after completing 31 years of service he was retired from service on 17-10-2005 on medical grounds. Though he retired from service 8 years ago, so far, his pensionary benefits have not been paid to him. The petitioner made several representations, which include the representations made on 17-10-2005 and 1-4-2013, but his requests for payment of pensionary benefits have not been considered.
In the above circumstances, the respondents are directed to consider and dispose of the representations made by the petitioner within a period of three months from the date of receipt of copy of this order and pay the pensionary benefits due to him.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
