The petitioner is not satisfied with the award made by the Arbitrator under Section 3-G(5) of the National Highways Act, 1956 for the land that has been acquired under the provisions of the aforesaid Act.
Shri Pranjal Mehrotra, learned counsel appearing for the respondents has stated that the petitioner can invoke the provisions of Arbitration and Conciliation Act, 1996 and in support of his contention placed reliance upon the decision of the Division Bench of this Court in Navin Tyagi and Others Vs. Union of India and Others reported in 2013 (10) ADJ 283(DB) and another Division Bench decision in Balveer Singh Bansal Vs. Union of India & Ors. in Writ Petition No.- 16242 of 2017 decided on 18 April 2017.
The petitioner does have a statutory alternative remedy as the petitioner can invoke the provisions of Arbitration and Conciliation Act, 1996. The Court, therefore, declines to interfere in this petition.
The writ petition is, accordingly, disposed of.
