For Petitioner : Mr.S.Silambu Selvan For Respondent : Mr.Jothimanian O R D E R The petitioner/husband has filed this transfer petition with a prayer to withdraw the proceedings in F.C.O.P No. 160 of 2017 from http://www.judis.nic.itnhe file of Family Court, Salem and transfer the same to the file of Sub Court, Poonamalle, to be tried along with H.M.O.P No.256 of 2013.
2. Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondent.
3. The respondent / wife has filed a petition for restitution of conjugal rights in Salem. The petitioner / husband has filed a petition in H.M.O.P.No.256 of 2013, before the Sub Court, Poonamallee, for divorce, and the same was transferred to Family Court, Salem, by order of this Court dated 21.07.2017 passed in Tr.CMP No.607 of 2014.
5. The learned Counsel appearing for the petitioner would submit that there is a chance of re-union, if the matter is referred for mediation.
6. Since there are ample mediators in Salem, a direction is given to the Family Court, Salem, to refer both the matters viz., F.C.O.P No. 160 of 2017 and H.M.O.P.No.256 of 2013, to the Mediation and Conciliation Center attached with Family Court, Salem. If the matter is not settled and returned to the Court, a further direction is issued to the Family Court, Salem, to dispose of both the cases, as http://www.judis.nic.ien xpeditiously as possible.
7. The Transfer Civil Miscellaneous Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
