JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHEA)
1. Pursuant to the notice issued herein, corpus Anita, aged 16, is produced before this Court with her aunt. Upon being asked, she has clearly stated that she has not been abducted by anybody and she is willingly living with her aunt, namely, Laxmiben. She also clearly stated that she does not want to return to the residence of the petitioner for her personal reasons. Learned counsel Mr.Adil Mirza, appearing for respondents No.4, 5 and 6 who were personally present in the Court, stated, on instructions, that those respondents have not and do not propose to coerce or in any way influence the petitioner's daughter for any purpose and that they will keep away from her in future. Under the circumstances, learned counsel Mr.Nayan Parekh submitted that no further order was required to be made in the matter.
2. It appears from the statements coming from learned counsel on both sides that respondents No.4, 5 and 6 have been called to the Court without sufficient reasons and on account of serious allegations made against them in the petition. It is further noticed that the synopsis preceding the petition is neither synopsis nor the list of dates and events as required under the rules. Therefore, office is requested to see that such petitions without proper, precise and short synopsis and clear list of relevant dates and events are not accepted and circulated for hearing. Learned counsel appearing in the High Court is expected to verify the facts and the basis of allegations for his own satisfaction and not merely propel the case presented by an illiterate petitioner in a very offensive language as though petition is one more means of addressing a letter to higher authorities. With these observations, the petition is disposed and notice is discharged and no order as to cost is made only because of the fact that the petitioner is stated to be a poor widow.
3. Learned counsel Mr.Adil Mirza is permitted to file his Vakalatnama for respondents No.4, 5 and 6 by tomorrow, i.e. 22.2.2012.
