[1] By way of this petition, the petitioner has challenged the order dated 02.03.2012, passed by the Deputy Secretary (Education Department), Sachivalaya, Gandhinagar and for a direction to the respondents to convert the petitioner school in grant able institution.
[2] Ms.
Mamtar R. Vyas, he learned counsel for the petitioner submitted that contention raised by the petitioner before the respondent authorities are not considered on merits.
[3] In that view of the matter, the impugned order dated 02.03.2012 is required to be quashed and the same is set aside and case is remanded back to the Deputy Secretary (Education Department), Sachivalaya, Gandhinagar. The case of the petitioner will be decided within four weeks from the date of the receipt of this order and will decide each of the contentions raised by the petitioner by passing a speaking order. The petitioner will appear before the authority on 23.07.2012. Thereafter, the authority will decide the case of the petitioner.
[4] In view of the above, the present petition stands disposed off accordingly.
