Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved by the accused-applicant Saraswati , who is involved in Case Crime No. 226 of 2018, under Sections 302, 328, 120B IPC, Police Station - Qila, District - Bareilly.
As per prosecution version, on 12.04.2018 at about 8:00 PM, applicant with co-accused Munna and Sher Singh has administered poison to Pritam husband of Saraswati, due to which he had died.
It is contended by learned counsel for the applicant that role of administering poison is assigned to Munna and co-accused Sher Singh. Applicant is named in the conspiracy. Main accused Munna has already been enlarged on bail vide order passed in Criminal Misc. Bail Application No. 37919 of 2018 dated 30.10.2018. Hence, the present applicant is also entitled to be admitted to bail on the ground of parity. Applicant has no criminal antecedents.
Per contra, learned A.G.A. has opposed the prayer for bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant- Saraswati, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
