Heard learned counsel for the petitioner and the learned Standing Counsel.
On being faced with the contention addressed on behalf of the petitioner that the District Magistrate has passed a non speaking order and fails to consider the explanation proffered by the petitioner, a Gram Pradhan, learned Standing Counsel submitted that the ends of justice would merit the impugned order being set aside subject to liberty being reserved to the District Magistrate to proceed in the matter afresh.
Accordingly and with the consent of parties, this writ petition is allowed. The impugned order dated 08 July 2019 is hereby quashed.
The Collector however shall have liberty to proceed in the matter afresh and in accordance with the 1997 Rules.
