The petitioner has approached this Court seeking a direction to the respondents 2 to 4 not to proceed further pursuant to Ext.P3. According to the petitioner, on receipt of Ext.P3 he has filed necessary objection and the matter was being heard by the Sub Divisional Magistrate, Tirur. In the mean time, the village authorities are insisting the petitioner to cut and remove the trees in terms of Ext.P3 order. Ext.P5 is a notice issued by the 2nd respondent directing the petitioner to appear before him on 04.06.2014. According to the petitioner, final order is yet to be passed. Having regard to the above factual situation, I am of the view that the writ petition can be disposed of without notice to the party respondents. There will be a direction to the second respondent to pass appropriate orders pursuant to Ext.P5 notice within a period of one month from the date of receipt of a copy of this judgment. In the meantime, further proceedings for cutting and removal of the trees in terms of Ext.P3 shall be kept in abeyance.
