THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioners herein are seeking direction to respondent No.2 to pass orders on the application filed by them on 8.1.2016 vide Annexure-F in proceedings bearing No.RRT (Dis) 48/2008-09 and for other alternative reliefs.
2. To-day when this matter is taken up for preliminary hearing the learned counsel for respondent Nos.3, 4, 8 and 9 would file a memo along copy of the final order passed in proceedings bearing No.RRT (Dis) 48/2008-09 on 26.7.2018. He would further bring to the notice of this Court that the very same petitioners have already filed an appeal against the said order in RA.No.108/2018-19 on the file of Assistant Commissioner, Bengaluru South Sub Division, Bengaluru. With this, it is stated that the present writ petition has become infructuous.
3. On going through the said memo and documents filed along with it, this Court would observe that in the light of subsequent developments the present writ petition does not survive for consideration as it has become infructuous.
4. Accordingly, the memo filed along with the documents is taken on record and the writ petition is dismissed as having become infructuous.
