JUDGMENT / ORDER

The petitioner was the party before the Lok Adalath held under the auspicious of District Legal Service Authority, Palakkad. As per the award petitioner was directed to pay Rs.3,75,000/- and also with a direction to pay Rs.5,000/- on or before 31.12.2013. If the petitioner commits any default, the Bank who is party to the above award is entitled to recover the amount with 16.5% interest per annum. The petitioner is also directed to pay revenue recovery and incidental expenses. The petitioner has approached this Court seeking a direction to the Bank to allow the petitioner to pay the amount awarded under Ext.P1 by instalments.
2. Heard the standing counsel for the Bank. He opposed the prayer of the petitioner. According to the learned counsel, the award is passed on a mutually agreed WP(C).No.15807/2014-A.
2 terms and the petitioner having accepted the award. It is not possible for this Court to extend the time. Considering the facts and circumstances of the case, the petitioner is given six months time to liquidate the entire liability pursuant to Ext.P1 award. The Bank is directed to issue statement of accounts showing the liability of the petitioner within two weeks. The petitioner shall pay the amount in six equal instalments starting from 1.11.2014. If the petitioner commits default in paying any of the instalments, the respondent Bank is free to take action against the petitioner.
Writ petition is disposed of as above.
