The petitioner seeks for refund of interest levied by the Bank during the period in which the Bank had delayed the resumption of property to the petitioner. 2. Admittedly the petitioner had availed of a loan from the respondent-Bank and had committed default. The Bank initiated recovery proceedings and had purchased the mortgaged property in the sale proceedings. The petitioner asked for resumption of the property. The petitioner was granted such resumption; however, there was some delay. Definitely if the petitioner wants resumption, the petitioner has to comply with the directions of the Bank. Having complied with such direction, the petitioner turns around and challenges the levy of interest. There is absolutely no merit in the said contention.
The writ petition is devoid of merit and the same is accordingly dismissed. No costs.
