Heard Sri Rama Shanaker Yadav, learned counsel for the applicant, Sri Prashant Kumar, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer for a direction to the Chief Judicial Magistrate, Jaunpur to decide the complaint case no. 946 of 2017 (Smt. Sarita vs. Tribhuwan and others) under section 452, 504, 506, 354, 427 IPC, Police Station Sikrara, District Jaunpur.
It is contended by the learned counsel for the applicant that the present case been filed on 25.8.2017 against the opposite party nos. 2 to 6. Till date not even statement under section 200 Cr.P.C. has been recorded by the court below, hence a direction may be issued for expeditious disposal of the case.
Perused the order sheet which reveals that the statement under section 200 Cr.P.C. has not been recorded till date. Therefore, in such circumstances without issuing notice to the opposite party nos. 2 to 6, it is being considered appropriate to issue a direction to the court below to make all endeavour to decide this case expeditiously preferably within a period of one year without permitting undue adjournments to either sides.
With this direction, this application is disposed of without issuing any notice to opposite party nos. 2 to 6 as it is an innocuous order. If the opposite party nos. 2 to 6 feel aggrieved, they may approach this Court.
