The applicant is the wife of opposite party no. 2 who has come up with a prayer to expedite the proceedings of Case No.331 of 2017 'Smt. Sarita Yadav vs. Anand Yadav' under Section 125 Cr.P.C., P.S.Cantt. District Bareilly pending in the court of learned Principal Judge, Family Court, Bareilly.
The proceedings of the case are very young and it is not known to this Court as to what is the relative priority of the cases before the Family Court where the case is pending. Nevertheless, proceedings under Section 125 Cr.P.C. have an inherent element of urgency about them as these are designed to bring immediate relief to a wife or the dependent entitled who has no means of sustenance. Looking to the fact that the wife is going without means some orders are required to be made. It is directed that the learned Principal Judge, Family Court, Bareilly would do well to expedite the proceedings of Case No.331 of 2017 'Smt. Sarita Yadav vs. Anand Yadav' under Section 125 Cr.P.C., P.S.Cantt. District Bareilly and decide the same expeditiously within eight months without granting any unnecessary adjournment to either of the parties.
It is further provided that the application for interim maintenance that is said to have been filed on behalf of the applicant shall be disposed of within a period of one month next positively from the date of receipt of a certified copy of this order.
With the above orders, this Application stands disposed of.
