Heard learned counsel for the petitioners as well as learned A.G.A.
Submission made by learned counsel for the petitioners is that petitioners are inter se husband and wife and they have solemnized the marriage on 28.02.2018. The next contention is that respondent no.4, who is the father of the corpus, has forcibly taken her away within two months of the marriage. It is next contended that petitioner no.2 has moved a representation to the Superintendent of Police, Deoria on 07.08.2019(annexure-4). The said representation is lying undecided.
Under the circumstances, the Superintendent of Police, Deoria is directed to carry out extensive search and in depth probe into the matter as to whether the claim of marriage is correct or not and other attending circumstances keeping in view that the FIR to this effect has already been lodged on 18.12.2018 as Case Crime No.475 of 2015 under Sections 363, 366 IPC and submit the report under Section 173(2) Cr.P.C. This exercise has to be completed within a period of one month from the date of production of certified copy of this order.
With the aforesaid observations, the present habeas corpus petition stands disposed of.
