Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed with a prayer to give a direction to the court below to decide the Case No. 1125 of 2014 (State Vs. Hori Lal Yadav and other), arising out of Case Crime No. 407 of 2013, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P. Act, Police Station Badagaon, District- Varanasi, pending in the Court of A.C.J.M., Court No. 5, Varanasi within a stipulated period.
Keeping in view that the matter relates to the year 2013, I hereby direct to the learned Additional Chief Judicial Magistrate, Court No. 5, Varanasi to gear up the matter and make necessary endeavour to conclude the trial within a period of six months from the date of production of the certified copy of the order after adhering to the provision of law u/s 309 Cr.P.C..
With the aforesaid directions, this 482 Cr.P.C. application is finally disposed of.
