Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with a prayer to direct the learned Principal Judge, Family Court, Ghaziabad to decide the Case No. 678 of 2020 (Smt. Sapna Tyagi Vs. Ripu Raj Tyagi), under Section 125 CrPC, Police Station Kavi Nagar, District Ghaziabad within stipulated period.
Learned counsel for the applicant has submitted that an application under Section 125 CrPC was filed on 12.10.2020 and since then, the same is pending and proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid application, as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid application.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
