1. Heard Sri Dhananjai Singh Yadav, learned counsel for applicant and learned A.G.A. for State.
2. The present bail application has been moved by accused-applicant for enlarging him on bail in S.T. No.96 of 2016, Case Crime No. 12 of 2016, under Section 306 IPC, Police Station Mauranipur, District Jhansi.
3. It is contended that earlier case crime No.12 of 2016 was registered under Section 498A and 302 IPC but after investigation, Police submitted charge sheet under Section 306 IPC wherein bail application of applicant was rejected by Additional Sessions Judge, Court No.1, Jhansi vide order dated 23.6.2016.
4. However, it appears that Informant filed an application under Section 156(3) Cr.P.C. and pursuant to order passed therein, case crime no.0012 of 2016 was registered on 10.01.2016 under Sections 498A and 302 IPC and therein Informant has categorically stated that wife of applicant i.e. daughter of Informant was burnt by pouring kerosene oil by husband and other family members on 16.6.2015. Admittedly, FIR has been lodged by parents of deceased and not by applicant. Postmortem examination report also confirmed case of death due to ante-mortem burn injuries.
5. Looking to entire facts and circumstances, at this stage, I do not find it a fit case for grant of bail.
6. Application is accordingly rejected.
