Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"1. Issue writ order or direction in the nature of mandamus directing the respondent no.3 to conduct the measurement of the land situated in Sanwaiya, Tehsil Aurai, District Bhadohi, having Gata/ Khasra No. 91 measuring 1.2650 Hectare, held by the petitioner, for which the application was given by the petitioner filed as Annexure 2 & 6.
2. Issue writ order or direction in the nature of mandamus directing the respondent no.3 to restrain the illegal occupants from interfere in peaceful use of land by petitioner and/or from taking possession of the land situated in Sanwaiya, Tehsil Aurai, District Bhadohi, having Gata/Khasra No.91 measuring 1.2650 Hectare."
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 3 to expedite the hearing of the aforesaid matter and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of four months from the date of production of self-verified copy of this order, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties and provided the functioning of the court concerned is not affected due to any reason related to COVID- 19 Pandemic.
With the aforesaid observations/ directions, the present petition is finally disposed of.
