JUDGMENT / ORDER

1. Heard learned advocate Ms. Vyoma Jhaveri for learned advocate Mr.Dipen Desai for the petitioners. She has submitted that petitioners will fill up requisite forms and submit necessary applications and will also pay all requisite fees as per rules of the respondent University and/or NCTE, latest by 12/05/2012.
2. In response to the notice, learned advocate Mr.Panchal has appeared for the respondent University. Learned advocate Mr.Panchal for the respondent University has submitted, stipulated and clarified that if the petitioners are found otherwise eligible in accordance with applicable rules and regulations of University and NCTE then petitioners' case shall be considered for affiliation and appropriate decision shall be taken on merits of the application by the competent committee/authority without taking into account or rather by condoning delay, if any, in making the application.
3. It is also clarified that the petitioners' case shall be considered in the meeting which is scheduled to take place on 15/05/2012 and that if the decision is taken in favour of petitioners after considering the case as aforesaid, then consequential actions of passing order of affiliation and allotment of students shall also be taken.
4. Learned advocate Mr.Panchal who appeared for the respondent University submitted that if the aforesaid formalities will be completed then petitioners' case will be considered in aforesaid manner.
5. In view of above clarification and observation, the petition stands disposed of as not pressed at this stage. Direct service today is permitted.
