The prayer made in the instant petition is for issuing direction to the trial court to decide interim injunction application paper no. 6-C pending in Original Suit No. 544 of 2018 instituted by the petitioners against the defendants-respondents within a specified time frame and for restraining them from creating any hindrance in use of house in dispute by the petitioners till the disposal of the application for temporary injunction.
A perusal of the order-sheet reveals that application for temporary injunction was posted for hearing on several dates but on account of delaying tactics of the defendants it has not been disposed of so far.
Accordingly, the instant petition is disposed of with direction to the trial court to ensure speedy disposal of the application for temporary injunction without granting unnecessary adjournments to either of the parties. In case the defendants seek adjournment, it shall be open to the trial court to consider the request for grant of ad interim temporary injunction to the petitioners.
