Sri Rajneesh Kumar Sharma has absented himself even in the third round.
The prayer prayed for is as follows:-
"(i) Issue a writ, order or direction in the nature of Mandamus directing the respondents 2 & 3 to ensure the compliance of Civil Courts order dated 16.7.2019 (Annexure No.2 to the writ petition) passed in O.S. No.728 of 2019.
(ii) Issue a writ, order or direction in the nature of Mandamus directing the respondent no.2 to decide the petitioner's representation/application dated 2.3.2021 (Annexure No.5 to the writ petition) within stipulated period, in the interest of justice."
There is already remedy provided order under Order XXI of C.P.C. which is meant for execution of Civil Court order. We cannot direct the authority to comply the order of Civil Court.
However, prayer no.2 relates to representation of the petition which is Annexure-5 to the writ petition, which the respondent no.2 may decide within a short time in accordance with law.
The writ petition stands disposed of.
