JUDGMENT / ORDER

1. Heard the learned counsel for the applicants, the learned AGA for the State and perused the record.
2. The learned counsel for the applicants submitted that a criminal case under section 304 IPC had been registered against the respondent no.2 and his family members. The respondent no.2 had also been in jail. The instant case has been cooked up by way of counter blast.
3. Notice on behalf of the respondent no.1 has been accepted by the AGA. Issue notice to the respondent no.2 by registered post, returnable at an early date.
4. Counter affidavit may be filed within four weeks and the rejoinder affidavit, if any, within two weeks thereafter. List for admission in the month of July 2010.
5. Till the next date of listing, no coercive process shall be issued and executed against the applicants Santosh Singh, Mohan Singh, Barati Singh and Jay Karan Singh in Case No. 733 of 2009 under sections 392, 323, 504 and 506 IPC, police station Pihani, district Hardoi, pending in the court of Additional Civil Judge (Junior Division) Hardoi.
