Heard Sri Dinesh Mishra, learned counsel for the appellant.
This appeal under section 173 of Motor Vehicles Act, 1988 has been filed by the son of deceased who is claiming that he is only legal claimant to get the amount of award.
The fact of the case reveals that while deciding the claim petition the Tribunal has considered it appropriate that the amount of compensation be distributed in between the wife of the deceased Smt. Santan and the sons of deceased namely Santosh Singh (appellant) and Chandan Singh.
By the impugned judgment and award dated 30.05.2018 passed by Motor Accident Claims Tribunal/ Additional District Judge, Court No.15, Allahabad in MACP No. 98 of 2011, the Tribunal has awarded a sum of Rs.2,95,000/-, out of which 60% has to be paid to the wife of the deceased, who is aged about 60 years and remaining 40% amount in two parts i.e. 20% each to the sons of the deceased.
Having heard the learned counsel for the appellant and after perusal of the impugned order, I find no illegality in the impugned order nor there is any reason to interfere in the matter. The order of the Tribunal is fully justified, as such, is confirmed.
The appeal is, accordingly, dismissed.
It is hereby directed that the compliance of the order of the Tribunal be made by the Insurance Company forthwith within a period of two weeks from today.
