Heard learned counsel for the petitioner and Sri Anil Babu, learned counsel for the State-respondents.
This petition impugns notices issued by the Special Chief Judicial Magistrate, Agra calling upon the petitioner to cooperate in an enquiry which has been instituted in respect of missing judicial records. Presently and as this Court reads these notices, no disciplinary action has been initiated against the petitioner who has admittedly retired from service.
In view thereof, the Court finds no ground to either entertain the writ petition or to interfere with the notices which have been issued. The petitioner having retired from the concerned judgeship is obliged to cooperate in the enquiry which is being undertaken by the Chief Judicial Magistrate. In this case, no cause of action arises presently since no adverse action has been taken.
The petition is dismissed.
