Learned counsel for the petitioners argues that while filling the online form, certain inadvertent errors occurred. While filling the marks obtained in Graduation examination, it is claimed that the marks obtained by the petitioner no. 1 were 418 out of 900, whereas while filling the form, it was filled as 918 out of 1800. In respect of petitioner no. 2 also a similar discrepancies occurred while filling the marks. The actual marks obtained by the petitioner no. 2 were 80 out of 100, however, while filling the form, it was filled as 165 out of 200.
Counsel for the petitioners relies upon the judgment of this Court dated 15.10.2020 passed in Service Single No. 8712 of 2020 (Shaviya Praveen Vs. State of U.P. and others), wherein this Court has disposed off the said writ petition with the following directions:-
"In case the petitioner had participated in the counselling that stands concluded, the respondent no.4 shall provide the petitioner one opportunity of making rectification of the details filled up in the online form as per correct details found recorded in the documents relied in support of details filled in the online form. Such opportunity of correction, if any, may be provided to the petitioner within a period of one month from today. All other reliefs claimed by the petitioner shall be subject to the outcome of the compliance of the order passed by this Court.
The petitioner shall move her application within a week from today which shall be entertained and appropriate orders be passed as aforesaid"
Keeping in view the said decision, the present petition is also disposed off with a direction that in case the petitioners had participated in the counselling that stands concluded, the respondent no.4 shall provide the petitioners one opportunity of making rectification of the details filled up in the online form as per correct details found recorded in the documents relied in support of details filled in the online form. Such opportunity of correction, if any, may be provided to the petitioners within a period of one month from today. All other reliefs claimed by the petitioners shall be subject to the outcome of the compliance of the order passed by this Court.
The petitioners shall move their application within a week from today which shall be entertained and appropriate orders be passed as aforesaid.
The petition is disposed off in terms of the said order.
Copy of the order downloaded from the official website of this Court shall be treated/accepted as certified copy of this order.
