Heard learned counsel for the appellant and learned AGA for the State, and perused the record. Notice upon opposite party no.2 has been served.
This criminal appeal has been filed against order dated 10.04.2018 passed by learned Special Judge(SC/ST Act)/ Additional Sessions Judge, Court No. 2, Firozabad in Bail Application No. 1020 of 2018 (Santosh Kumar vs. State of U.P.) arising out of Case Crime No. 296 of 2017, under Section 406, 420, 467, 471, 504, 506 I.P.C. and 3(2)(5) SC/ST Act, Police Station Linepar, District Firozabad, whereby, bail application of appellant was rejected.
As per the prosecution case, the appellant assured that he shall arrange a class IV job and for that Rs. 3,50,000/- was demanded, Rs. 10,000/- advance was paid to the appellant in the presence of Mewalal, thereafter, entire sum was paid; complainant was fraudulently duped.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that the appellant is the prime accused; allegation is against him. It is not in the public interest to enlarge the appellant on bail Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the appellant.
Accordingly, the appeal is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
