Heard learned counsel for the applicant.
This petition alleges disobedience of an order dated 25 May 2017 in terms of which the learned Judge had disposed of the petition with a direction to the respondents therein to consider the representation of the applicant. It is not disputed by the learned counsel that consequent to the death of his father in harness in 1995, he was granted appointment on the post of Junior Clerk on 3 August 1999. The claim which is now laid is that since the post of Gram Panchayat Adhikari has been revived with effect from 29 October 2004, he should be absorbed on the post of Gram Panchayat Adhikari, a post which was held by his father.
The Court finds no ground to initiate proceedings in contempt in the above factual backdrop and more so having regard to the principles laid down by the Full Bench in Shiv Kumar Dubey Vs. State of U.P. And Others; (2014) 2 ADJ 312.
Consequently, the petition is dismissed.
