Heard learned counsel for the applicants, learned A.G.A. and learned counsel for O.P. No. 2.
This application has been filed with a prayer to quash the order dated 26.10.2009 passed by learned J.M. -II, Court No. 26, Lucknow in case No. 140 of 2007 whereby the discharged application filed under section 245 Cr.P.C. has been rejected.
From the perusal of the record it appears that impugned order it appears that learned Magistrate concerned has considered the material collected by the I.O. during investigation which disclosed the commission of the offence. The learned Magistrate concerned has not committed any error in rejected the discharge application. There is no illegality in the impugned order, therefore, the prayer for quashing the same is refused.
Accordingly this application is dismissed.
