Learned counsel for the petitioner at the very outset submits that he may be permitted to delete respondent no. 5 from the array of the parties to the writ petition during course of the day He is permitted to do so during the course of the day.
Heard learned counsel for the petitioner and learned Standing Counsel for the State-Respondents no. 1,2 and 3.
By means of this petition the petitioner has come to this Court stating that he was duly selected by the Commission on 19.12.2010. The petitioner was allotted J.P. Inter College, Campier Ganj, Gorakhpur. The petitioner has completed more than five years of regular service as L.T. Grade Teacher and has now prayed for promotion in the Lecturer Grade (Math).
It is submitted that there is vacancy under the promotion quota but his name has not been considered and it has to be considered by the Selection Committee of Promotion headed by the Joint Director. It is further submitted that according to the paragraph No. 25 of the writ petition, the papers have been forwarded by the Committee of Management to the Regional Level Committee but no decision has taken place.
The writ petition is disposed of with the observation that the Regional Level Committee will first ensure whether the vacancy upon which the petitioner is claiming promotion is under promotion quota and if any requisition has been sent to the Commission for selection, the claim of the petitioner be considered and appropriate order be passed in accordance with law, as far as possible, within a period of three months from the date of presentation of a certified copy of this order before it.
