This writ petition has been filed, inter alia, for the following relief:
" Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 3 to retrain the respondent nos.4 to 5 not to interfere in peaceful repairing of the wall of the room , situated in House no. 308A, Sadar Bazar Cantt. Allahabad within a stipulated period of time."
Heard the learned counsel for the parties and perused the record.
Considering the facts and circumstances of the case, it is provided that in case the petitioner approaches the Chief Executive Officer, Cantonment Board, Allahabad along with an application ventilating his grievance within ten day from today, the said authority shall pass appropriate orders in accordance with law after making due inquiry and hearing the petitioner within fifteen days from the date of receipt of a certified copy of this order.
It is made clear that this court has not expressed any opinion on the merits of the case and the said authority has to take decision on its own merits.
With the above observation, this writ petition is finally disposed of.
