The matter was taken up on 08.10.2021 and this Court has proceeded to pass following order:-
"Compliance affidavit filed today by the Circle Officer, Soraon, District Prayagraj, is taken on record. It is submitted that the team, constituted by the Senior Superintendent of Police, District Prayagraj, under the leadership of the Circle Officer, Soraon, District Prayagraj, is taking all necessary steps to ensure recovery of the victim girl.
A prayer has been made to grant some more time to ensure recovery of the victim girl. As prayed by the learned A.G.A., the matter is posted on 25.10.2021 as fresh.
By the next date fixed, recovery of the victim girl shall be ensured by all possible means.
Compliance affidavit filed today by the Investigating Officer, posted as Sub Inspector, Police Station Phaphamau, District Prayagraj, is taken on record.
A perusal thereof indicates that though the Officer has submitted his unconditional apology to the Court but has tried to defend his inaction in making proper investigation for a period of approximately three months. In the previous orders, we have noted our anguish that the Investigating Officer did not make searches to ensure recovery of the victim girl and the investigation was done lackadaisical manner.
It is informed by the learned A.G.A. that a disciplinary enquiry has been initiated against the Officer concerned.
While discharging the notice issued by this Court for initiating proceedings for violation of the order of this Court for not filing an affidavit against the Investigating Officer, we refer the matter to the Senior Superintendent of Police, District Prayagraj, to take necessary action at his end to instil sense of dedication and devotion in the police force and fix accountability in discharge of their duties.
Put up this case on 25.10.2021 as fresh."
On the matter being taken up today, Mrs. Archana Singh, learned AGA filed an affidavit. The same be taken on record. On the strength of said affidavit, she submits that chargesheet has been filed in the matter on 22.10.2021 and the victim has also been recovered, as such the writ petition has rendered itself as infructuous and the same is liable to be dismissed.
In view of the above, the writ petition is dismissed as having become infructuous.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
