High Court Of Judicature at Allahabad|15 April, 2021

JUDGMENT / ORDER

Hon'ble Rajeev Singh,J.
Heard Sri A.K. Singh, learned counsel for the petitioners, Sri H.P. Srivastava, learned Additional Chief Standing Counsel for the State and Sri Pankaj Gupta, learned counsel for the respondent No.9 through video conferencing.
Notice has not been served to opposite party Nos.1, 2 and 6. Although service of notice to a necessary party is a rectifiable defect, but taking note of the fact that the Panchayat election has already been notified on 26.03.2021, we decline to entertain the present writ petition for the nature of relief sought herein. It is however open to the petitioners to avail the remedy by means of an election petition, at the appropriate stage, if the cause so arises to them.
The writ petition is dismissed.
