JUDGMENT / ORDER

The petitioner herein is the 4th accused in Crime No.105/CC/SII/07 – EOW III of the CBCID and the case is now pending before the Judicial First Class Magistrate Court -I, Kannur. It is submitted that the case now stands transferred to the Register of Long Pending Cases. On the apprehension of arrest in execution of the warrant of arrest issued from the court, the petitioner seeks orders under Section 482 of the Code of Criminal Procedure directing the trial court to consider his request for bail on the date of surrender itself. Of course, a direction to release him on bail cannot be now granted. However, a direction can be made to the trial court to consider and dispose of the application for bail, if filed, on the date of surrender itself, in the interest of justice. In the result, this petition is closed with direction to the learned Magistrate, that in case application is filed by the petitioner for bail on surrender in Crime Crl.M.C No.6301 of 2014 2 No.105/CC/SII/07 – EOW III of the CBCID, the same shall be judiciously considered and decided on the date of surrender itself, however, with notice to the learned Assistant Public Prosecutor. The petitioner is granted seven days time to surrender before the learned Magistrate. During the said period, execution of warrant of arrest will stand suspended.
