A life interest holder sued for injunction against his close relatives. The trial court, finding that she is not residing in the property and residing elsewhere, dismissed the suit. The appellate court confirmed the said finding of the trial court.
2. It is now seen that at the appellate state, the plaintiff died and her legal representatives came on record. The appellate court confirmed the decree of the trial court.
3. As already stated, the plaintiff had only a life interest over the plaint schedule property. It is difficult to understand how the suit could be carried on by the legal heirs. May be that they have other distinct interest over the estate. But that cannot be agitated in this proceedings.
RSA.503/2014. 2 Reserving the liberty of the legal heirs of the plaintiff to take such steps as are available in law, this appeal is dismissed.
