JUDGMENT / ORDER

The petitioner herein is the sole accused in C.C No.1816/2014 of the Judicial First Class Magistrate Court – II, Thiruvananthapuram. Crime in the said case was registered under Sections 294(b), 323, 324 and 506(ii) IPC on the complaint of one Sunil Kumar. The petitioner seeks orders quashing the prosecution under Section 482 Cr.P.C on the ground that he and the complainant have settled the whole dispute amicably out of court. The de facto complainant Sunil Kumar is the 2nd respondent in this proceeding. He has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint. I am well satisfied that there is a real settlement between the parties, and continuance of prosecution in such a situation will not serve any purpose, other than wasting the precious time of the court. No doubt, nobody will support the prosecution in such a situation. In the result, this petition is allowed. The prosecution as against the petitioner herein in C.C No.1816/2014 of the Judicial Crl. M.C No.6630 of 2014 2 First Class Magistrate Court -II, Thiruvananthapuram will stand quashed under Section 482 Cr.P.C, and the bail bond, if any executed by him will stand discharged.
