This writ petition has been filed seeking the following relief:-
"(I) issue a writ, order or direction in nature of mandamus directing the respondent no. 2 to decide the Appeal No. 01091/20158 bearing computer case no. C201805000001091 (Shiv versus Sant Prasad) under Section 24(4) U.P. Revenue Code-2006 pending before the Court of Additional Commissioner, Administration-II, Gorakhpur Mandal, Gorakhpur within a stipulated period "
The contention of counsel for the petitioner is that demarcation order passed in his favour in proceedings under Section 24 has been challenged by the opposite parties by means of an appeal wherein no interim order is operating. Despite absence of any interim order, the actual demarcation has not been effected and the boundary marks have not been erected by the revenue authorities and hence, this writ petition.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2 i.e. Additional Commissioner, Administration-II, Gorakhpur Mandal, Gorakhpur to decide the appeal as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
