Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents no. 1 to 3 and Sri Diwakar Singh, learned counsel appearing for the respondent no. 4 - Gaon Sabha.
Present writ petition has been filed seeking a direction to the respondents to remove the encroachment from the land of gata no. 188 measuring its area 0.0420 Hectare i.e. situated in Village Lakhipur, post office Tesahi Buzurg, Pargana Hathgam, Police Station Khaga, district Fatehpur within time as fixed by this Court.
After some arguments were advanced by learned counsel for the petitioner, he made a prayer that this writ petition may be dismissed as withdrawn with liberty to approach appropriate forum for redressal of his grievance.
Prayer aforesaid is granted.
This writ petition is, accordingly, dismissed as withdrawn with liberty aforesaid. No costs.
