Heard learned counsel for the petitioner, Sri Diwakar Singh, learned counsel for the Gaon Sabha and learned Standing counsel.
In compliance of the earlier order of this Court, learned Standing Counsel has obtained instructions which is placed before this Court and the same is taken on record.
By means of the present petition, the petitioner has prayed for following relief:
(i) issue a writ, order of direction in the nature of mandamus commanding/ directing the concerned respondent authority to remove the encroachment made by encroacher over the Arazi No. 250 & 285 recorded as pond in revenue record situated in village Devana, Pargana Athervan, Tehsil Manjhanpur, District Kaushambi.
In the instructions placed today before this Court, there is report of Sub-Divisional Magistrate, Manjhanpur, Kaushambi to the effect that a case has been registered under Section 67 of U.P. Revenue Code, 2006 against the alleged encroachers as Case No. T 201814360302569.
In view of the above, no further orders are required to be passed. However, it is expected that the proceedings drawn against the alleged encroachment shall be concluded as early as possible, preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid observations and directions, the petition is consigned to records.
