Heard learned counsel for the appellant, Shri Kamendra Singh, learned counsel for respondent no.6, Shri Aakash Rai, learned counsel for respondent no.7 and perused the record.
This special appeal has been filed against the impugned order dated 30.7.2019 whereby learned Single Judge has granted time to the respondents to file counter affidavit in Writ A No.10595 of 2019 (Sant Lal vs. State of U.P. and 6 others), which is still pending before this Court.
Learned Single Judge has observed in the said writ petition that appointment of respondent no.6 as Principal, by transfer, shall be subject to the final decision of the writ petition (mentioned hereinabove).
Considering the nature of the order passed by learned Single Judge, we do not see any justification to interfere in the matter.
The special appeal is misconceived. Hence dismissed.
