Heard Sri Ravish Kumar Singh, learned counsel for the petitioners and learned Standing Counsel for the respondents.
The time schedule for processing of applications and finalisation of examination centres for the Board examination to be conducted by the Board of High School and Intermediate Education is provided under the Government Order dated 16.10.2018. The Government Order dated 16.10.2018 provides that the entire process of applications and disposal of issues relating to nomination of examination centres shall be done online. The Government Order dated 16.10.2018 also goes on to provide a time schedule for processing of such applications and disposal of objections. The applications have to be submitted initially by the institution on or before 25.10.2018. In case any short comings or deficiencies are noted in the applications a representation is to be made by the institution on or before 05.11.2018. Such representation has to be made online at the website of Board of High School and Intermediate Education.
The time line provided in the Government Order dated 16.10.2018 for nomination of the Examination Centres has to be adhered to strictly. In case, the permission to relax the aforesaid time line is granted it will create uncertainty in the selection of the Examination Centres. This will cause a disarray in the examination schedule itself. Since the future academic careers of a large number of students is at stake, the imperative of public interest demands that there should be inflexible adherence to the time line and the procedure provided in the Government Order dated 16.10.2018.
The petitioners had initially submitted online application on 26.09.2018. However certain deficiencies were noted. Petitioner admittedly failed to submit online representation against the deficiencies on 05.11.2018.
As per the case of the petitioners, the petitioners made such representation on 06.11.2018 before the District Inspector of Schools. The procedure for making a representation to remove the infirmities or deficiencies has not been followed by the petitioner institution. The petitioners have submitted the application after the last date of submission of said application. Further the institution has not submitted application online and has forwarded the same to an authority not authorised under the Government Order dated 16.10.2018.
In view of above, the writ petition is dismissed.
