(By Sri.Honappa, HCGP) …Petitioner …Respondent This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Cr.No.357/2018 (S.C.No.168/2019) of Konanakunte P.S., Bangalore for the offence p/u/s 302, 309 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Heard the learned counsel for the petitioner and learned HCGP for the respondent-State and perused the records.
2. The brief facts of the case are that the accused- petitioner is the husband of deceased-Geetha and he was suspecting the fidelity of his wife. Due to that, he was ill- treating, harassing and also quarrelling with her in the house situated at Royal County, J.P.Nagar 8th Phase, Bengaluru. In this background, it is alleged that on 01.10.2018 at about 6.45 PM, the accused and deceased- Geetha were quarrelling with each other and when the complainant and others came to the stop and break open the door, they found deceased-Geetha was in a pool of blood and accused-petitioner also stabbed himself with a knife. Thereafter, the accused shifted to hospital, whereas, deceased-Geetha was died at the spot.
3. Respondent-police has arrested the accused.
On perusal of the charge-sheet papers, it is clear that there are many number of eye witnesses to the incident. Under these circumstances, petitioner is not entitled to be enlarged on bail.
Accordingly, petition stands dismissed.
However, petitioner can renew his bail application before the trial Court after examination of material witnesses, if advised.
