THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 15680 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) Instead of inviting counter affidavit, we feel that the impugned order is such a nature that the writ petition itself can be disposed of without counter affidavit.
The petitioner before us is an non-judicial officer. He had been working in the judicial administration in the district of Krishna. Thereafter, on his request the High Court, in exercise of power under law, posted him in the district of Guntur. Now he seeks repatriation to his original place and accordingly he made a representation to the High Court through the District Judge. Instead of forwarding the said representation, the District Judge, Guntur, himself has taken a decision to reject such request for repatriation.
In our view the District Judge has no power to do so. It is for the High Court under the law which can take a decision in this regard. We therefore set aside the impugned order of the District Judge and direct the Registrar (Administration), High Court of Andhra Pradesh, to place this matter before the appropriate authority for taking decision in this regard.
The writ petition is accordingly disposed of.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
