On the last occasion when the matter was taken up on 23.3.2018 it was intimated by learned counsel for the applicant that he had sent written notice to the learned counsel for the informant but he had refused to accept the same which was recorded in the order itself.
Today also learned counsel for the informant is not present and the case is listed peremptorily.
Heard learned counsel for the applicant, learned AGA for the State and perused the material placed on record.
The present bail application has been filed by the applicant in case crime No. 335 of 2014 under Section 498A, 304B IPC and Section 3/4 D.P. Act, police station Nawabganj, district Farrukhabad with the prayer to enlarge him on bail during the pendency of trial.
It is contended by learned counsel for the applicant that the applicant is husband who has been falsely implicated for the death of his wife, who died on account of poisoning. It is argued that it is a case of suicide and the applicant has remained in jail for the past more than seven years and the trial is not proceeding.
After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the bail rejection order,first information report as well as averments as contained in the present bail application, this Court is of the opinion that the learned counsel for the applicant could not make out any good ground for enlarging the applicant on bail.
Accordingly, the bail application is hereby rejected.
After the order was passed learned counsel for the applicant prayed that the trial of the aforesaid case may be expedited.
Accordingly, court below concerned is directed to conclude the trial of the aforesaid case, expeditiously, strictly in accordance with law, after hearing the parties and without granting unnecessary adjournment to either the parties, preferably within a period of one year from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any court of law.
