"Heard Shri Deepesh Kumar Ojha, learned counsel for the applicant, Shri Shailendra Kumar Singh, learned counsel for the first informant and Shri Pankaj Mishra, learned counsel for the State is present.
At the outset, learned counsel for the State makes a preliminary objection in the instant application under Section 438 Cr.P.C. is not maintainable in view of the judgment rendered in case of Shahaab Ali (Minor) and another Vs. State of U.P. : 2020 SCC OnLine AII 45.
Learned counsel for the applicant prays for and is granted 10 days' time to prepare the matter.
Put up this case in the week commencing 20.12.2021, as fresh."
Learned counsel for the applicant states that the present anticipatory bail application be dismissed as withdrawn.
As prayed, the present anticipatory bail application is dismissed as withdrawn.
