Heard learned counsel for the petitioner, Sri Prem Prakash Yadav, counsel for respondent No.2 and learned Standing Counsel for respondent No.1.
The petitioner is appointed as Anudeshk at Purwa Madhymik Vidyalaya Ratangarh, Noorpur, District Bijnor. The petitioner has submitted application for grant of maternity leave for a period of 16.09.2019 to 13.03.2020 (annexure no.3 to the writ petition).
The grievance of the petitioner is that respondent no.2 has not considered the application of the petitioner for grant of maternity leave, therefore, the petitioner is entitled to maternity leave in view of several Government Orders and also the judgment of this Court in Writ-A No.3486 of 2019 (Anshu Rani vs. State of U.P. & 2 Ors.).
Learned counsel for the respondents submits no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to the authority concerned to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case, respondent no.2-District Basic Education Officer, Bijnor is directed to consider and decide the application of the petitioner for grant of maternity leave (annexure no.3 to the writ petition) in accordance with law and in the light of judgment of this Court passed in the case of Anshu Rani (supra) within a period of two months from the date of production of certified copy of this order.
The writ petition is disposed of subject to the observations made above.
