The instant petition is for issuing direction to the court below to decide Misc. Case No. 79 of 2018 under Section 372 of the Indian Succession Act expeditiously.
A perusal of the order-sheet reveals that the third party Kamla has filed objections to the application of the petitioner for grant of succession certificate. It also seems that by order dated 16.05.2019 the proceedings were transferred to the court of Additional Civil Judge, Court No. 5, Bareilly.
The petition is accordingly disposed of by providing that the court below shall endeavour to decide the case expeditiously by fixing short dates and without granting unnecessary adjournments to either of the parties.
