JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the accused in Crime No.45/2014 of Kumbla Excise Range registered for the offence punishable under Section 55(a) of the Abkari Act.
3. The allegation against the petitioner is that on 13.09.2014 he was found transporting 22 bottles, each containing 180 ml, of IMFL meant for sales in the State of Karnataka only. The petitioner has been in custody from 13.09.2014 onwards.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. The learned Public Prosecutor has pointed out that the petitioner is the accused in crime No.69/2013, which was registered for the offence punishable under BA.7622/2014 : 2 :
Section 55(a) of the Abkari Act. In the light of the criminal antecedence of similar nature on the part of the petitioner, I am of the view that he is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
